A 56-year-old man admitted Wednesday that he’d sexually assaulted two people in December 2016 as part of a plea agreement.
Scott Martin pleaded guilty to two counts of gross sexual imposition, a class A felony. Under the agreement presented to Northwest District Judge Benjamen Johnson, Martin would be sentenced to eight years in prison, with one year suspended. He would have to serve five years of supervised probation after being released from prison and also register as a sex offender.
Johnson ordered a presentence investigation and scheduled a sentencing hearing for Aug. 13. At that hearing, he will decide whether to accept or reject the agreement.
Martin was arrested in December 2016 and accused of having sexual contact with a 23-year-old man and a 15-year-old boy who were passed out in an apartment in the complex where Martin worked.
Police said the 23-year-old called them the next morning and told them he’d had a few shots of brandy, then started feeling extremely tired. He said he awoke to find Martin performing a sex act, and that he told Martin to stop, after which he left, according to an affidavit of probable cause filed in Northwest District Court.
The 15-year-old told investigators he’d had a soda at the apartment and that he fell asleep on the couch, court records indicate. He woke up and discovered Martin performing a sex act on him, told Martin to stop and then went to an upstairs bedroom and locked the door.
The boy said he woke up later to find Martin again performing a sex act on him, that he pushed Martin away and then left the apartment, charging documents state.
Martin told police he had arranged the meeting and that he’d drank alcohol with the 23-year-old, as well as that he’d performed a sex act on the 23-year-old, an investigator wrote in the affidavit of probable cause.
