Governor signs extradition order

North Dakota Gov. Jack Dalrymple has received and signed paperwork ordering the extradition of Michael Keith Spell and Lester Vann Waters Jr. to Montana, according to a spokesperson for the governor.

The two Colorado men were arrested and charged with aggravated kidnapping in the case of Sherry Arnold, a Sidney, Mont., resident who went missing during a morning jog on Jan. 7. Both are being held in the Williams County Correctional Facility in Williston awaiting extradition to Montana.

The governor's signature paves the way for the extradition process to take place, according to the State's Attorney's Office in Williston.

Each opted to fight extradition, and their extradition hearings are scheduled for next Tuesday. The state of Montana would have had to prove that the two men being held were in fact the men wanted and that all the paperwork was accurate and in order.
