The proposal before the commission is for a preliminary plat and application for a planned unit development overlay district for Dublin Estates. The proposal is being brought forward by Kyle Hexom of Daybreak Properties LLC.
Planning and Zoning director Kent Jarcik told commission members that Hexom's plan has been discussed. Hexom is hoping to get variances regarding some issues with the plan.
Hexom explained his proposed lots are currently listed as condos and he wants to change that so they're listed as R-3 as single-family homes.
"With the economy the way it is right now, it's very difficult to finance them. Some banks have stopped financing completely when it comes to those. With the P.U.D. ordinance coming into being, we looked at it and thought maybe we can free things up and solve that problem," said Hexom. Hexom said the 17-lot neighborhood its looking to construct needs a few variances approved involving setbacks for various things such as the garages and spacing between lots. He said with the plan its organized, he thinks the variances wouldn't be too big of a deal and could produce a good-looking neighborhood.
Jarcik said as things stand right now, they would for the most part be in compliance and close to guidelines when it came to major things such as square footage on the lots. He said the main issue is approving the set backs and spacing on lots that Hexom seeks.
"He's asking for variances if the building code would allow for them. He's asking to allow to build up to the zero property line on the lots to allow for building patios," said Jarcik.
Typically for a single-family lot in R-3 zoning, a 50-foot home has to have a 5-foot set back between lots.
The proposed set backs were for 10 feet in the front yard and 20 feet for the front garage. This was in addition to the proposed building up to the zero property line.
Building official Doug Lalim told the commission that what they were doing was basically deciding to recommend to the city commission to approve to the pending changes and approval from the Building Department. He added depending on where the lot is in terms of the set back, there might need to be a firewall standard to be applied.
Hexom told the commission if it approved the plan, they would be willing to work with the city on things such as firewalls, the set backs and whatever else was necessary. He added one thing they are already dealing with is improving a utility access area.
Commissioner Tim Kleven thought the plan, despite the variances, seemed like a good one.
"This looks like a well thought out plan looks-wise to me," said Kleven.
After further discussion, three separate motions were made to approve recommendations to the city commission. A motion to recommend approval of the development plan was made and approved unanimously. Commissioners Jerry Fleck and Janice Arnson were not in attendance.
Motions to recommend approval for the planned unit development overlay district with the proposed setbacks and approval of the preliminary plot were both approved unanimously. All three motions were subject to changes made by the city commission and subject to approval through the city's building code.
