City Commission revises engineering agreement

The Williston City Commission consented to an amendment to engineering services agreement with Kadrmas, Lee and Jackson Inc.(KLJ) of Williston at Tuesday's Williston City Commission meeting.

The agreement involved a sequence of construction improvements at Sloulin Field International, including the new airport terminal.

In a letter presented by Airport Manager Rick Marburger, KLJ stated that the original engineering agreement price was set at $311,292 based on the original total estimated construction costs of $1,613,700.

The first agreement was dated Oct. 14, 2003, for the design and construction of a new airport terminal building, site grading, sanitary sewer, storm sewer, airport parking, airfield lighting equipment and miscellaneous items.

The first amendment to the project is dated Feb. 23, 2005. Amendment 1 increased the project's scope to include airport parking and the access road, reconstructing the terminal apron (concrete), and aircraft rescue and firefighting (ARFF) truck and building. The KLJ letter added that with the other improvements that increased the construction costs $3,339,824, about a 51 percent increase over the original estimated costs. According to the letter, "The increase in the project scope required additional design engineering, material testing services, asbestos abatement services, architecture services, critical project phasing and a longer construction period to complete the project. Amendment 1 revised the fees under the engineering agreement to a total of $546,248."

In many cases, 80 to 90 percent of the project, was or will be paid for by matching federal grant dollars.

Still snags, in the meeting the construction deadline added to the costs of the project.

The letter goes on by saying, "Amendment No. 2 covers additional work performed by the engineer as a result of the contractors not meeting the project timetable as per specifications. This agreement shall amend the total amount of engineering services eligible to be charged to the construction observation phase. Amendment No. 2 increases fees paid to the engineer to a total of $581,510."

The amendment stated that the increased amount for engineering is based on actual costs of completion of the project.

"We added a lot more projects after we started, and kept getting more grant money," Marburger said. "It's based on the same percentages as the original agreement."

Nobody appeared at the public protest portion of Tuesday's Williston City Commission meeting.

Areas to be improved include alley improvement at Block 6 of the Original Townsite, Seventh Avenue West street/concrete, 19th Street West street/sewer improvements, Avenue R & S street improvements, 12th Avenue East water and street improvements, 23rd Street West - water, sewer and street projects, 24th Street water main improvements, and Main Street valve replacement.

Two written protests were submitted - one for the R & S streets, and the other for the water, sewer, and alley improvement for Block 6 of the Original Townsite, but these were deemed insufficient to delay or stop those portions of the project.

Commissioners agreed to block off portions of Main Street for the July 5 Blast street dance/vendor sale at the request of the Williston Area Chamber of Commerce.

Commissioners Brad Bekkedahl and Frank Underhill were absent.

Williston City Auditor John Kautzman broached on the subject of giving the Williston City Hall a new look with a sign. Board members opted to table it until there was a full board present.

At Meiers' request, board members concurred with the cross-connection to extend city water services at the Martin and Reiger Subdivision and implemented a water service agreement for three lots for Williams Rural Water District water service extension. The requests came after Martin and Sylvia Reiger asked permission to develop a house on lot 3 of the MR Subdivision, in north Williston at 34th Street East.

Commissioners gave Williston Fire Chief Alan Hanson informed the board he would apply for over $100,000 from the Firefighting Grant for protective equipment. He said the local match for the grant would either be $6,500 or $13,000, depending on the level of the required match.
